Terms of Use

In short. You may install and play Color Killer on the Apple devices you own. Don't resell it, pull it apart to ship your own version, or cheat the leaderboards. One optional purchase removes ads permanently. Apple handles the money and the refunds. The game is provided as it is.

1. Who these terms are with

These terms are an agreement between you and the independent developer and publisher of Color Killer ("the game", "we", "us"). They cover the iOS app and this website. By installing or using the game, you accept them. If you don't, please don't install it.

2. Apple's standard EULA applies too

Apps distributed through the App Store are also governed by Apple's Licensed Application End User License Agreement. Where these terms and Apple's standard EULA conflict, Apple's standard EULA governs to the extent of the conflict. In particular: this licence is granted by us, not by Apple; Apple has no obligation to furnish support for the game; and Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

3. Your licence

We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use one copy of the game on each Apple-branded device you own or control, for your own non-commercial entertainment, in accordance with the App Store Usage Rules.

4. What you may not do

  • sell, rent, sublicense, or redistribute the game or any part of it;
  • reverse engineer, decompile or disassemble it, except to the extent that applicable law expressly permits despite this restriction;
  • remove or obscure any copyright, trademark or attribution notice;
  • modify the game, its saved data, or the network traffic around it in order to post scores you did not earn, unlock achievements you did not earn, or obtain the ad-free purchase without paying for it;
  • use the game to break the law, or in any way that interferes with other players' use of Game Center leaderboards.

We may ask Apple to remove a score or achievement obtained by cheating. We have no accounts, so there is nothing for us to ban — the consequence of tampering is simply a broken game and a score nobody credits.

5. Purchases

The game is free. It offers exactly one in-app purchase: Remove Ads, a non-consumable product that permanently stops the game from requesting third-party ads.

  • It is not a subscription. There is nothing to renew or cancel, no in-game currency, no loot box, no energy timer and nothing else to buy.
  • It is tied to your Apple Account, not to a device. Reinstalling the app, switching to a new iPhone, or restoring from a backup does not cost you anything: tap Restore purchases in the game's Settings.
  • Apple takes the payment. Prices are shown in your local currency at the point of purchase and may vary by region and over time. We never receive or see your payment details.
  • Refunds are Apple's to give. Request one at reportaproblem.apple.com. Your statutory withdrawal and consumer rights are not affected by anything in these terms.
  • If the game is ever withdrawn from the App Store, a purchase already made stays restorable through Apple for as long as Apple supports restoring it.

6. Advertising

Until Remove Ads is purchased, the game shows ads supplied by Google AdMob, including a rewarded video you may choose to watch to continue a run. We do not control which ads are served and we do not endorse them. Report an inappropriate or broken ad to support@color-killer.com with a screenshot and we will pass it to Google. What data the ads involve is set out in the privacy policy.

7. Game Center

Leaderboards, achievements and friend comparisons are provided by Apple Game Center and are subject to Apple's terms. They are optional; the game is fully playable signed out. We cannot edit, restore or transfer Game Center data.

8. Our content

The game, its source code, artwork, sounds, name, wordmark and icon are owned by its developer and protected by copyright and other laws. Nothing in these terms transfers ownership. Screenshots and video of your own play may be used freely, including monetised video; press and creators are welcome to the assets in the press kit.

9. Updates and availability

The game may be updated, changed or withdrawn at any time. Gameplay balance in particular is expected to change. We do not guarantee that any specific feature, level, orb or score will remain available in a future version.

10. No warranty

To the maximum extent permitted by law, the game is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that it will be uninterrupted or error-free.

Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you. Where you deal with us as a consumer, your mandatory statutory rights are unaffected.

11. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special or consequential damages, or for lost data or lost profits, arising from your use of the game. Our total aggregate liability is limited to the amount you actually paid for the game in the twelve months before the claim — which, for most players, is nothing. Nothing here limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited.

12. Third-party claims and Apple

We, not Apple, are responsible for addressing any claim that the game or your possession and use of it infringes a third party's intellectual property rights, and for any product liability, legal or regulatory non-compliance, or consumer protection claim relating to the game. You confirm that you are not located in a country subject to a US Government embargo or designated as terrorist-supporting, and that you are not on any US Government list of prohibited or restricted parties.

13. Governing law

These terms are governed by the law of the country in which the developer is established, without regard to conflict of law rules. If you are a consumer, nothing in this clause deprives you of the protection of the mandatory consumer law of your country of residence, or of your right to bring proceedings in your local courts.

14. Changes to these terms

If these terms change, the version number and date at the top change with them, and the new version applies to use of the game from the date it is published. Material changes will be noted in the App Store release notes.
